Taking steps to fight TNCs impunity
While welcoming the first report of the Open-ended IGWG on transnational corporations and other business enterprises with respect to human rights, FIAN International reiterates to States that public policy spaces are being captured by big business.
As a participant in the first session and as a member of the Treaty Alliance , FIAN International underlined that it sees the creation of the Open-ended Intergovernmental Working Group (IGWG) as a historic step taken by the Human Rights Council (HRC). “It reflects a growing understanding of States, of their human rights obligations to protect against offenses and crimes committed by TNCs and other businesses,” said FIAN in an oral statement at HRC.
The report reflects the rich discussions of the first session , as it is believed these will ultimately lead to ensuring proper national and international governance of States over transnational corporations (TNCs) and other business enterprises. FIAN International has particularly welcomed the recognition of the international cooperation of States in matters of extraterritorial protection, as a key topic to be regulated in the upcoming legal instrument. “We firmly believe that this instrument will serve the interests of the full community of States, home States and host States alike,” FIAN stresses.
Yet, the organization adds, States should be attentive of the current corporate capture of public policy spaces. “Against this background, States have to strengthen their joint determination and their legal instruments to globally rule over TNCs in accordance with the sovereignty of their peoples.”
