Brazil: Guarani-Kaiowá, land conflicts and malnutrition kills indigenous adults and children

The deaths of Guarani Kaiowa indigenous children due to malnutrition have been a continuous issue in Mato Grosso do Sul, Brazil. Since 2005, 53 indigenous children below age five died in the region, 12 in 2007. The deaths are concentrated in Dourados, where 11 thousand people are concentrated, and in Amambai. The lack of respect, protection and, especially, the non implementation of the constitutionally defined guarantee to traditional lands, which is a pre-requisite for the realization of the Human Right to Adequate Food, and the right to feed oneself, lead to hunger, malnutrition and violence against the Guaranis. In 2007 alone, 48 Guarani Kaiowas were murdered. Parallel to this, reports point to an increasing criminalization of indigenous leaders, involved in the struggle for land. At the root of this situation is the inadequate access to land, a consequence of the looting and destruction of the traditional indigenous territories due to the failure of Brazil to respect and protect the human rights of the indigenous peoples.

Background:

In the State of Mato Grosso do Sul the Guarani Kaiowá population is of approximately 27.500 people. Traditionally the Guaranis have been an itinerant people whose territory included most of the southern part of Latin America.  For these people, the land where they live – the Tekohá – means “the place where we realize our way of being”, a social political space. In the early 20th century the Guarani-Kaiowás were enclosed in very small demarcated indigenous lands. Until the 70´s they were able to migrate to and find refuge in non occupied lands. But with the progressive occupation of large extensions of the land in the region, including river banks, with the capital intensive production of soy beans, this space was progressively reduced. Since then more and more indigenous families were forced into the limited demarcated land, seriously reducing their capacity to provide for themselves in terms of food, clean water, fuel for food production, medicinal herbs and increasingly worse sanitary conditions. In the 90`s a severe increase in the rate of suicides was observed as well as those of alcoholism.

In 2007, 76 indigenous people were assassinated in Brazil, out of them 48 were Guarani Kaiowas from Mato Grosso do Sul. Since 2005, 53 Guarani Kaiowá children died of malnutrition, and presently there are at least 600 others who present signs of malnutrition. The homicides, suicides, the alcoholism, and the malnutrition deaths are strongly linked to the limited extensions of land presently occupied by the Guaranis in Mato Grosso do Sul, and to their struggle against it. The government has limited itself to provide food and health assistance to the families, among other small scale programs, but has not advanced in the demarcation of the 52 traditional lands demanded by the Guaranis.

Under the human right to food, Brazil is duty-bound to investigate and punish the persons responsible for the murders of the Guaranis, to protect the indigenous people against the practice of undue criminalization, to provide adequate food and access to resources for the Guarani to feed themselves, as such access is currently beyond their control. Brazil should therefore take immediate measures to demarcate the land in question, and also step up social transfer measures and the implementation of needed public policies to prevent further starvation deaths until the Guaranis are resettled on their lands.

FIAN Mandate
As a state party to the International Covenant on Economic, Social and Cultural Rights, Brazil is duty-bound under international law to respect, protect and fulfil the Guaraní Kaiowa’s access to land to feed themselves. This indigenous group is threatened by hunger, malnutrition, and land conflict related violence, and international attention is urgently necessary.

Call to Action

Please write letters to the Brazilian President Lula, to the Minister of Social Development Patrus Ananias, to the Minister of Human Rights Paulo Vanucchi and to the Minister of Justice Tarso Genro asking them to take the appropriate measures to guarantee the Guarani Kaiowá´s rights.

Excelentíssimo Presidente,
Estou muito preocupado com a situaçao dos mais de 27500 indígenas Guarani-Kaiowá que habitam o Estado do Mato Grosso do Sul. Estima-se que no estado a desnutrição afeta pelo menos 600 crianças indígenas. Na região de Amambai há 180 crianças com problemas severos decorrentes da insuficiência na alimentação.Nos últimos três anos mais de 53 crianças indígenas morreram por desnutrição. Somente no ano de 2007, 43 Guaranis foram assassinados e outros cometeram suicídio, e muitos tornaram-se vítimas de alcoolismo. Na raiz desta situação está a omissão do Governo Federal Brasileiro que não garante que a FUNAI realize o trabalho de identificação e demarcação das terras indígena, não elabora políticas públicas voltadas para esta população, não protege adequadamente aos povos indígenas contra a violência, discriminação e criminalização de suas lideranças, e não garantia de acesso aos territórios tradicionais dos povos indígenas, conforme o que está previsto na Constituicão federal. As matas, onde os Guaraní-Kaiowà podiam coletar alimentos como as frutas, o mel, caça, pescado e a matéria-prima para fazerem suas casas e utensílios., foram roubadas e destruídas por fazendeiros Esta situação será agravada com a implantação das 30 usinas de cana de açúcar previstas para aquele Estado nos próximos três anos.
O Brasil como Estado Parte de Pactos Inter-nacionais de Direitos Humanos da Organização das Nações Unidas (ONU) da Convenção Americana sobre Derechos Humanos,  do Protocolo de San Salvador e do Convênio 169 da OIT, assumiu compromissos no âmbito do direito internacional de proteger e respeitar os direitos à terra, à alimentação, à água e em especial à vida das famílias indígenas. Portanto solicito respeitosamente que Vossas Excelências adotem medidas garantindo que:
• A FUNAI faça com extrema urgência a identificação e delimitação de todas as terras Indígenas do Mato Grosso do Sul conforme previsto no CAC, referente ao Procedimento Administrativo MPF/RPM/DRS/MS 1.21.001000065/2007-44. Após o processo de identificação e delimitação que sejam imediatamente homologadas as terras pelo Ministério da Justiça.
• Seja implementado uma política, a médio e longo prazo, de recuperação ambiental das áreas devastadas, na perspectiva de recompor as condições básicas do modo de ser e de viver dos povos Guarani-Kaiowá, garantindo-se o direito a se alimentar..
• Enquanto este processo é desenvolvido a alimentação dos povos indígenas deve ser garantida por distribuição regular de cestas básicas que respeitem a cultura alimentar destes povos ou por outros programas que garantam a alimentação adequada.
• Sejam investigados, com agilidade, os crimes cometidos contra os indígenas, e punidos os responsáveis.
• Os Guarani-Kaiowás sejam protegidos contra práticas de criminalização de sua luta pela terra e por seus direitos em geral.

Mr President,
I am very concerned with the situation of the more than 27500 Guarani-Kaiowá indigenous people who live in Mato Grosso do Sul State. According to official estimates, at least 600 indigenous children suffer from malnutrition. In the Amabaí region alone, 180 children have health problems due to inadequate food intake. More than 53 indigenous children died due to malnutrition in the State, since 2005. In the year of 2007 alone, 43 Guaranis were murdered, many committed suicide and many others became victims of alcoholism. The root cause of this situation is the omission of the Federal Brazilian Government that: does not provide adequate conditions for FUNAI to carry out the identification and demarcation of indigenous lands; does not elaborate public policies aimed at this population, does not adequately protect the indigenous peoeple against violence, discrimination and criminalization of their leaderships, and does not ensure access to their traditional lands, as foreseen in the Federal Constitution. The woods, where theGuaraní-Kaiowà could obtain food such as fruits, honey, game, fish and the raw material to build house and utensils, were robbed and destroyed by large farmers. This situation will worsen with the foreseen installation of 30 new sugar mills in the State, within the next three years
Brazil as State Party of the International Covenant on Economic, Social and Cultural Rights (UN) of the American Convention on Human Rights, of the San Salvador Protocol and of the ILO Convention 169, committed itself international to protect, respect and fulfil the human rights to land, food, water and life of the indigenous peoples. I therefore respectfully request that your Excellencies guarantee that:
• FUNAI speedily identifies and demarcates all indigenous lands in Mato Grosso do Sul, as foreseen in the CAC, part of the Administrative Procedure MPF/RPM/DRS/MS 1.21.001000065/2007-44, and that the identification and demarcation process is immediately sanctioned by the Ministry of Justice.
• An environmental rehabilitation policy for the devastated areas is implemented the medium and long term, aimed at recomposing the needed conditions for the Guarani-Kaiowá way of being and living, with the guarantee of the right to feed oneself.
• During the recovery period, the access to food of the indigenous people must be guaranteed through the regular distribution of culturally adequate food baskets or other programs that can guarantee the access to adequate food.
• The crimes against the Guarani-Kaiowas are urgently investigated, and the people responsible for them punished.
• The Guarani-Kaiowás are protect against the criminalization for their struggle for land and rights in general.
